Venezuelan lawyers in the United States
Venezuela is a civil-law country, and that shapes your path in the United States: New York and Texas require an LL.M. in addition to your degree before you can take the bar exam, while California lets you take it if you are admitted as a lawyer in Venezuela. Without the exam, with 3 of the last 5 years of practice you can be certified as a Foreign Legal Consultant in Florida, New York or Texas. Your documents are apostilled in Venezuela, online, also from abroad.

Law school in Venezuela
Each university sets the length of the law degree in its curriculum, and it is not the same at the universities consulted: five years at the Universidad de Los Andes (ULA), after a twelve-week introductory cycle, at the Universidad Nacional Experimental de los Llanos Centrales Rómulo Gallegos (UNERG) and at the Universidad Católica del Táchira; nine semesters at the Universidad Católica Andrés Bello (UCAB); ten semesters at the Universidad Monteávila; twelve trimesters at the Universidad Metropolitana; and four years, in twelve trimesters, at the Universidad Bicentenaria de Aragua. The length of your own program is shown in your certified transcript (notas certificadas) and your curriculum (pénsum), and it is what an evaluator in the United States looks at.
To graduate, you must complete:
- Pass your university's full curriculum.
- Since the 2005 Community Service Act, community service has been a requirement for the degree: at least 120 academic hours, over no less than three months and unpaid, once at least 50% of the program is completed (Ley de Servicio Comunitario del Estudiante de Educación Superior, Gaceta Oficial No. 38.272 of September 14, 2005, arts. 6, 8 and 16).
The courses in the law degree
The curricula of the universities consulted are not organized the same way. At the Universidad Católica del Táchira (UCAT) and at UNERG, the curriculum is organized by year of study (at UCAT, with some one-semester courses and 221 credit units in the 2024–2025 curriculum); at the Universidad de Los Andes, the introductory cycle is followed by four years of common courses and a fifth year in two levels, with two electives and the Práctica Forense (trial practice); at the UCAB and the Monteávila, courses run by semester (at the UCAB, 251 credit units), and at the Metropolitana, by trimester. Even so, the same subjects recur from one curriculum to the next, in these areas:
- General foundations
- Introduction to Law (Introducción al Derecho) or General Theory of Law (Teoría General del Derecho), Roman Law (Derecho Romano), Legal History (Historia del Derecho), Sociology of Law (Sociología Jurídica), Philosophy of Law (Filosofía del Derecho), Legal Logic and Argumentation (Lógica y Argumentación Jurídica), Political Theory (Teoría Política) and, depending on the university, Canon Law (Derecho Canónico), Political Economy (Economía Política), Research Methods (Metodología de la Investigación), Public Speaking (Oratoria) and Legal Writing (Redacción Jurídica).
- Civil law (Derecho civil)
- Persons (Personas), Family (Familia), Property and Real Rights (Bienes y Derechos Reales), Obligations (Obligaciones), Contracts and Security Interests (Contratos y Garantías), and Successions (Sucesiones). Several universities number them: at UCAT, Civil Law I (Persons), Civil Law II (Property), Civil Law III (Obligations), Civil Law IV (Contracts and Security Interests) and Civil Law V (Family and Successions).
- Procedural law (Derecho procesal)
- General Theory of Procedure (Teoría General del Proceso), Civil Procedure (Derecho Procesal Civil), Evidence (Derecho Probatorio or Derecho de Pruebas), Criminal Procedure (Derecho Procesal Penal) and, in several curricula, Labor Procedure (Derecho Procesal Laboral), Constitutional Procedure (Procesal Constitucional), Administrative Litigation (Contencioso Administrativo) and Alternative Dispute Resolution or Arbitration (Medios Alternativos de Resolución de Conflictos, Arbitraje).
- Criminal law (Derecho penal)
- General and special criminal law (Derecho Penal: the theory of crime and punishment, and specific offenses), Criminology (Criminología) and Forensic Medicine (Medicina Legal); in some curricula, Criminalistics (Criminalística) or Business Criminal Law (Derecho Penal de los Negocios).
- Public law: constitutional and administrative (Derecho público)
- Constitutional Law (Derecho Constitucional), Human Rights (Derechos Humanos), Administrative Law (Derecho Administrativo, in one or more courses) and Tax Law (Derecho Tributario); in several curricula, also Environmental Law (Derecho Ambiental) and Agrarian Law (Derecho Agrario).
- Commercial law (Derecho mercantil)
- Commercial Law (Derecho Mercantil), in one or more courses; the UCAB divides it into Foundations of Commercial Law (Fundamentos de Derecho Mercantil), Companies and Commercial Obligations (Sociedades y Obligaciones Mercantiles), and Negotiable Instruments, Commercial Contracts and Insolvency (Títulos Valores, Contratos Mercantiles y Crisis Patrimoniales).
- Labor law (Derecho laboral)
- Labor Law (Derecho del Trabajo), individual and collective, and Social Security Law (Derecho de la Seguridad Social).
- International law (Derecho internacional)
- Public International Law (Derecho Internacional Público) and Private International Law (Derecho Internacional Privado); in some curricula, also International Civil Procedure (Derecho Procesal Civil Internacional) or Comparative Law (Derecho Comparado).
- Legal practice and professional ethics
- Practice courses by area (administrative, procedural, criminal, labor and tax practice, at UCAT), Legal Clinic (Clínica Jurídica, at the UCAB), Professional Practice (Práctica Profesional, at the Monteávila), Trial Practice (Práctica Forense, at the ULA) and internships (pasantías), plus Professional Ethics (Ética or Deontología Jurídica) and seminars.
Besides the required courses, the curricula include electives (at the UCAB, three electives and three linked to its graduate program; at the Metropolitana, five; at the ULA, two from an area of your choice), practice or internships (a graduation requirement at the UCAB and the Metropolitana; four semesters of Práctica Profesional at the Monteávila) and, at some universities, a thesis (trabajo de grado): the Metropolitana's Taller de Trabajo de Grado or UNERG's Seminario Tesina de Grado; at the ULA it is optional and, if you choose it, exempts you from the internships and the Servicio Jurídico Gratuito (free legal service). The Metropolitana also requires a comprehensive exam (examen comprehensivo) to graduate: it is a university requirement, not an exam to practice. Some recent curricula add courses on law and technology, such as Information and Communication Technology Law (UCAT) or New Technologies Law (Metropolitana).
Year by year
This is how the degree usually progresses, according to the official curricula of the UCAT, the UCAB, UNERG, the Monteávila and the Metropolitana (and, for the thesis, the ULA's curriculum page); in semester or trimester plans, each year groups two semesters or three trimesters. The order changes from one university to another: Family law, for example, is taught in the first year at the UCAB and the Monteávila, and in the fifth at the UCAT.
- First year
- Introduction to law (at the UCAB, General Theory of Law), Civil Law I (Persons), the foundations of constitutional or public law, legal history or Roman law, and logic, argumentation or legal writing. All five curricula agree on these.
- Second year
- Property and real rights, the general part of Criminal Law, Constitutional Law and Public International Law. At the UCAB and the Metropolitana, Obligations already begins.
- Third year
- Obligations, Administrative Law, General Theory of Procedure or Civil Procedure I, and the special part of Criminal Law. At several universities, also Labor Law and the first Commercial Law courses.
- Fourth year
- Procedure, in all five curricula, and, at the UCAT, UNERG and the Metropolitana, evidence as well; Commercial Law; Contracts and Security Interests at the UCAT and the Monteávila. Supervised practice begins: the UCAT's Prácticas, the UCAB's Clínica Jurídica (legal clinic) and the Monteávila's Práctica Profesional. At the ULA, the thesis (trabajo de grado), if you choose it, is registered in the fourth year. At the Metropolitana, the curriculum ends here, with the twelfth trimester.
- Fifth year
- Criminal Procedure, Tax Law, Successions and professional ethics, along with practice, internships or the thesis. At the UCAB, the fifth year is a single semester.
The heaviest courses
In the curricula that give credits, the courses with the heaviest load are in civil law, especially Obligations, Contracts and, at the UCAB, Property. At the UCAT, Civil Law III (Obligations) and Civil Law IV (Contracts and Security Interests) carry 9 credit units each, the most in its curriculum; at the UCAB, the courses with the most credits are Property and Real Rights and Contracts and Security Interests, with 7 each. Civil law is also the longest sequence: it runs from the first year to the last, with five courses and 36 credit units at the UCAT and nine courses at the Monteávila. Next come civil procedure and evidence (at the UCAT, Civil Procedure I to III and Evidence, from the third to the fifth year), administrative law, with two to four courses depending on the university, and commercial law. At the Monteávila, practice also weighs heavily: Práctica Profesional I to IV, with 5 credit units each, in the last four semesters.

Some of the country's law schools, with their official pages. This is not a complete list or a list of approved universities: check yours in the official register, below.
Accreditation and licensing
Law school accreditation
The 1970 Universities Act speaks of approval and authorization of faculties and schools, not accreditation; the 2009 Organic Education Act leaves "the evaluation and accreditation… of programs" to special laws (art. 35, item 4). The Consejo Nacional de Universidades (CNU, the National Council of Universities) sets the requirements for creating faculties and schools and decides each request (Ley de Universidades, art. 20); a private university may operate only if the national executive authorizes it by decree, with the CNU's favorable opinion, and only the faculties the CNU approves may operate in it (arts. 173 and 180). In the CNU orders published in Gaceta Oficial No. 42.645 of June 7, 2023, undergraduate programs "are created, approved and authorized" (se crean, aprueban y autorizan), and graduate programs "are created, accredited and renewed" (se crean, acreditan y renuevan). In July 2026, according to the Ministry of University Education, the CNU confirmed technical commissions that will take up, among other matters, "the creation of a national quality accreditation system." How to check that your university was authorized is explained below.
The license to practice
To practice you need the law degree (Ley de Abogados, the Lawyers Act, Gaceta Oficial No. 1.081 Extraordinario of January 23, 1967, art. 3) and registration with a Colegio de Abogados (bar association) and with the Instituto de Previsión Social del Abogado, Inpreabogado, the lawyers' social security institute (art. 7). You apply in writing to the Colegio, with your law degree duly registered (protocolizado), or with a revalidation certificate if you graduated abroad (art. 8). The degree is registered at a Registro Principal, which records academic degrees and certificates (Ley de Registros y Notarías, Gaceta Oficial No. 6.668 Extraordinario of December 16, 2021, art. 66). If you regularly practice in another Colegio's territory, you join that Colegio within 30 days (Ley de Abogados, art. 10). Revalidating a foreign degree is the exclusive competence of the national universities (Ley de Universidades, art. 182). You take an oath before the Colegio's board, which records your degree, issues your certificate of registration and reports it to the Federación de Colegios de Abogados, the Ministry of Justice and the Corte Suprema de Justicia, now the Tribunal Supremo de Justicia (Ley de Abogados, art. 8): it is a notice, not an approval. No court grants the license.
Mandatory to practice: the Ley de Abogados (art. 7) requires registration with a Colegio de Abogados and with Inpreabogado. The Colegios make up the Federación de Colegios de Abogados de Venezuela, the national federation of bar associations, which has its own Disciplinary Tribunal.
Examination process
There is no professional exam to practice: the Ley de Abogados requires the registered degree and registration with the Colegio and Inpreabogado, with no exam.
How to verify the license of a lawyer from Venezuela
The official lookup is the Inpre Abogados lookup of the Saren (the registries and notaries service). You enter the lawyer's Inpreabogado number and the system validates it. To know that the number belongs to that person and that they are in good standing, ask for a certificate from their Colegio de Abogados, where their registration is recorded (Ley de Abogados, art. 8).
Lawyer discipline in Venezuela
Lawyers are disciplined by the Colegios de Abogados (bar associations) themselves, through their Disciplinary Tribunals. Each Colegio has one, independent of its board, with five full members and three alternates (Ley de Abogados, art. 58). It hears cases at first instance, and its decisions are appealed to the Disciplinary Tribunal of the Federación de Colegios de Abogados de Venezuela, which has seven members (arts. 60 and 66).
The Disciplinary Tribunal hears violations of the Ley de Abogados, its Regulations (Reglamento) and the rules of professional ethics (Ley de Abogados, art. 61), set out in the Código de Ética Profesional del Abogado Venezolano, the code of professional ethics the Federación adopted in 1985; under that code, breaching the duties in its Title I is a disciplinary offense (Código de Ética, art. 3). It acts on its own initiative or on a complaint, filed in writing and confirmed by the complainant under oath (Reglamento de la Ley de Abogados, arts. 61 and 62). Within eight business days it takes the first steps, including, if possible, the lawyer's statement, and decides whether to open a case (art. 63). If it does, it notifies the lawyer in person or, if the lawyer cannot be found, appoints defense counsel (art. 64); the Fiscal (prosecutor) files the charges within ten business days (art. 65), and there are twenty business days for evidence, after which closing arguments are heard (art. 66). The tribunal decides as a jury, by majority (Ley de Abogados, art. 65), with at least three votes (Reglamento, art. 68). The sanctions are a private or public reprimand and suspension from practice (Ley de Abogados, art. 70), and reprimands cannot be appealed (art. 66). Disciplinary action is time-barred eighteen months after the conduct, unless the Colegio provides otherwise (Código de Ética, art. 60).
How a lawyer loses the license
The Ley de Abogados does not include exclusion (exclusión, comparable to disbarment) or cancellation of the lawyer's registration among its sanctions: the most serious one is suspension from practice (art. 70). For serious breaches of ethics, honor or professional discipline, or for failing to appear to receive a reprimand, the suspension runs from one month to one year; a lawyer who refuses to pay their dues after being reprimanded is suspended until they pay, and a lawyer sentenced to prison is suspended for the full length of the sentence, from the moment it becomes final. The Colegio's Disciplinary Tribunal decides it, and it can be appealed to the Federación's tribunal within five business days of notification (art. 66), which decides within thirty calendar days (Reglamento de la Ley de Abogados, art. 69). A suspension does not cancel the registration: it is noted in the margin of the entry in the register of law degrees (Libro de Inscripciones de Títulos de Abogados) and reported to the courts, the justice ministry and the Colegios. Once the lawyer proves that the sanction was served or has lapsed, the Colegio issues a certificate that the suspension has ended (constancia de cese de la suspensión) and reports it to the same bodies (art. 72).
The certificates you will be asked for in the United States
For Foreign Legal Consultant, to register as in-house counsel or for the character and fitness review, states usually ask for recent proof that your license is in good standing, and for your records.
- Certificate from your Colegio de Abogados (good standing): Proves that you are registered and in good standing, with your date of registration.
It is issued by the Colegio where you are registered, which keeps the register of law degrees (Ley de Abogados, art. 8). For Foreign Legal Consultant, Florida and New York require it to come from the authority with the final say over discipline. States want it recent: for Foreign Legal Consultant, Texas, no more than 30 days old; California, from the last six months. - Inpreabogado registration certificate: Proves your registration with the Instituto de Previsión Social del Abogado, which is mandatory to practice (Ley de Abogados, art. 7).
It is issued by the Instituto de Previsión Social del Abogado (Inpreabogado). - Disciplinary record certificate: Proves whether you have any sanctions or disciplinary proceedings.
Discipline is handled by your Colegio's Disciplinary Tribunal and, on appeal, by that of the Federación de Colegios de Abogados de Venezuela (Ley de Abogados, arts. 58, 60 and 66). For Foreign Legal Consultant, Texas asks for a statement of discipline from each jurisdiction where you are authorized, no more than 30 days old. - Criminal record certificate (certificado de antecedentes penales): For the character and fitness review.
It is issued by the Ministerio del Poder Popular para Relaciones Interiores, Justicia y Paz, the interior and justice ministry (Ley de Registro de Antecedentes Penales, Gaceta Oficial No. 6.712 Extraordinario of July 20, 2022, art. 14). You request it online, also from abroad.
How to check that your university is recognized
The official register is the Libro de Oportunidades de Estudio (study opportunities guide) of the Oficina de Planificación del Sector Universitario (OPSU), the university-sector planning office.
It is the official search tool for the academic programs offered by public and private higher education institutions: you search by state, institution and academic program, such as Derecho (law). In addition, a private university may operate only if the national executive authorized it by decree, with a favorable opinion from the Consejo Nacional de Universidades (National Council of Universities), the CNU (Ley de Universidades, Gaceta Oficial No. 1.429 Extraordinario of September 8, 1970, art. 173). Its degrees take legal effect when the national executive endorses them (refrenda), through the education ministry (art. 182); today, university education is the responsibility of the Ministerio del Poder Popular para la Educación Universitaria, which convenes the CNU. To check yours: it should have its authorization decree, and your degree should be registered and, if it is from a private university, endorsed.
If your university closed
Before you start any process, ask the Ministerio del Poder Popular para la Educación Universitaria who issues your certified transcripts today: New York and Texas want them sent directly by the institution.
Documents usually requested
- Your Abogado degree, registered at a Registro Principal and, if your university is private, endorsed by the ministry.
- Your certified transcript (notas certificadas) and your program's curriculum (pénsum), with the hours or credits of each course.
- Proof of your registration with the Colegio de Abogados and with Inpreabogado.
- If you will apply as a Foreign Legal Consultant, register as in-house counsel or apply for admission: a recent certificate from your Colegio and your disciplinary record certificate.
- Your criminal record certificate.
- Your national ID card (cédula) or your passport.
- A certified English translation of each document and, if it is required, its apostille.
Hague Apostille
Venezuela has been a party to the Hague Apostille Convention since March 16, 1999 (it acceded on July 1, 1998), as has the United States: to use a Venezuelan public document here, the apostille is enough, with no consular legalization. The apostille is issued by Venezuela, not by a consulate. Its competent authority, according to the HCCH, is the foreign ministry (Cancillería), now called Ministerio del Poder Popular para Relaciones Exteriores y Comercio Internacional: it handles apostilles through its electronic legalization and apostille system (Sistema de Legalización y Apostilla Electrónica), and each apostille issued since May 2, 2019 can be verified online on its lookup page. Since July 2026, the electronic apostille for university degrees is requested on the online services portal of the Saren, tramites.saren.gob.ve, which the Government presented for citizens inside and outside the country.
What weighs when a degree from Venezuela is evaluated
- Civil law. In New York, your degree cannot be equivalent in content, because Rule 520.6 requires content equivalence only of degrees from countries whose law is based on English common law: you cure it with an in-person LL.M. of at least 24 credits. In Texas, Section 5 of its Rule 13 requires your degree, an LL.M. that meets its criteria and authorization to practice, all three.
- Duration. New York and Texas also require your degree to be equivalent in duration to that of a U.S. law school; in New York, at least 83 credits in law subjects, 64 of them in classroom courses. That is why your certified transcript and your full curriculum matter.
- Being admitted in Venezuela. Your registration with the Colegio de Abogados and with Inpreabogado proves that you may practice. California lets you take its exam if you are fully admitted in your country, and the Foreign Legal Consultant license in Florida, New York and Texas requires membership in good standing of a legal profession subject to effective regulation and discipline.
- Your years of practice. For Foreign Legal Consultant, Florida, New York and Texas require 3 of the 5 years before the application; California, 4 of the previous 6 years. Start keeping proof of your practice now.
- That your university is recognized in Venezuela. Texas requires a degree from a law school accredited in your country. We explain it above, under "How to check that your university is recognized."
- Distance learning. New York does not count online or distance courses toward duration, and Texas does not accept a degree earned mainly online or by distance learning.
- Documents your university sends. New York and Texas want your transcripts sent directly by your university, not by you, with an English translation. Request them early.
Good to know
Your degree and your license are two different things. The university grants the degree; to practice, you also have it registered (protocolizado) and register with a Colegio de Abogados and with Inpreabogado. In the United States you may be asked for proof of both: of the degree, to evaluate your legal education; of the registration, to know whether you are authorized to practice.
In 2019, Venezuela broke off diplomatic relations with the United States (foreign ministry statements of March 12 and 14, 2019). On March 5, 2026, the Government of Venezuela announced that both governments had decided to restore their diplomatic and consular relations. To be confirmed: which Venezuelan consulates in the United States are providing services today; an official notice from the Venezuelan foreign ministry would say so. For the apostille of your degree and for your criminal record certificate you do not depend on them: both are requested online, from Venezuela's authorities.
Where to move forward with this degree
- Florida Without the exam: Foreign Legal Consultant with 3 of the last 5 years of practice, or in-house counsel for a company in Florida. Its bar exam requires having practiced first in another state.
- New York Where the most foreign-trained lawyers take the bar exam; with a civil-law degree, after an in-person LL.M. of 24 credits. It also has the Foreign Legal Consultant license and in-house counsel registration.
- California If you are admitted in Venezuela, you take its exam without additional studies in the United States, with a certificate of good standing from the last six months.
- Texas Bar exam with your degree, your admission in Venezuela and an LL.M. that meets its criteria (synchronous online classes count). It is the state that licensed the most Foreign Legal Consultants from 2021 to 2025.
- Louisiana Its private law follows the civil-law tradition: instead of a full LL.M., an equivalency determination and 14 credits at an ABA law school. It does not offer the Foreign Legal Consultant route today.
- Puerto Rico Civil law and a bar exam (Reválida) in Spanish, but it requires a J.D., in which up to a third of the credits may be recognized. Since 2026, a lawyer from another country may be in-house counsel for their employer.
- Georgia It lets a foreign-trained lawyer who is authorized to practice in their country take the bar exam after an LL.M. that meets its criteria.
